# Florida HOA and Condo SB 4-D / SIRS Requirements (2026)

Florida Senate Bill 4-D (2022) and subsequent legislation created major new requirements for Florida condominium associations following the Champlain Towers South collapse in Surfside (2021).

## Key Requirements

### Milestone Inspections
- **Required for:** Condominium buildings 3+ stories tall
- **Trigger:** 30 years after certificate of occupancy (25 years if within 3 miles of coastline)
- **Phase 1:** Visual inspection by licensed engineer or architect
- **Phase 2:** If Phase 1 finds substantial structural deterioration — detailed inspection required
- **Deadline:** Buildings that reached the age threshold before July 1, 2022 had until December 31, 2024

### Structural Integrity Reserve Study (SIRS)
- **Required for:** All condominium buildings 3+ stories
- **Deadline:** December 31, 2024 (for existing buildings)
- **Content:** Must assess and fund reserves for: roof, load-bearing walls, floor, foundation, fireproofing, plumbing, electrical, windows/exterior doors, and any item over $10,000 replacement cost
- **Reserve waiver:** No longer permitted — associations must fund reserves based on SIRS findings

Associations that have not completed their SIRS or funded reserves face:
1. Difficulty renewing or obtaining property insurance
2. Higher premiums due to perceived structural risk
3. Potential coverage exclusions for structural failures
4. Lender requirements — many mortgage lenders now require SIRS completion before approving loans on units
