# Florida HOA and Condo Insurance Compliance Checker

Use this guide to determine your Florida condominium association's compliance status under Senate Bill 4-D (2022) and the Structural Integrity Reserve Study (SIRS) requirements.

## Compliance Checklist

### Step 1: Does the Milestone Inspection Requirement Apply?

The milestone inspection is required if your building is:
- 3 or more stories tall, AND
- 30 years old or older (25 years if within 3 miles of the coastline)

If yes, the milestone inspection was required by **December 31, 2024** for buildings that reached the age threshold before July 1, 2022.

### Step 2: Has the SIRS Been Completed?

The Structural Integrity Reserve Study (SIRS) was required by **December 31, 2024** for all condominium buildings 3+ stories.

The SIRS must cover:
- Roof
- Load-bearing walls and primary structural members
- Floor and foundation
- Fireproofing and fire protection systems
- Plumbing
- Electrical systems
- Windows, exterior doors, and other apertures
- Any item with a deferred maintenance cost or replacement cost exceeding $10,000

### Step 3: Is Reserve Funding in Place?

Effective January 1, 2025, Florida condominium associations may no longer waive reserve funding. Reserves must be funded based on the SIRS findings.

## Insurance Implications by Compliance Status

| SIRS complete, reserves underfunded | Some carriers may decline; higher premiums |
| SIRS not complete | Most private carriers will decline; Citizens may be only option |
| Milestone inspection failed (Phase 2) | Significant coverage challenges; may require structural repairs before binding |
