# Florida Workers' Compensation Insurance

Workers' compensation insurance is **required by Florida law** for most employers. Construction employers with **1 or more employees** must carry coverage. Non-construction employers with **4 or more employees** must carry coverage.

## Florida Workers' Comp Requirements

| Employer Type | Employee Threshold |
|---|---|
| Construction industry | 1 or more employees |
| Non-construction industry | 4 or more employees |
| Agricultural | 6 or more regular employees or 12 or more seasonal employees |
| Domestic workers | Not required |

Corporate officers in construction are automatically included unless they file a valid exemption. Up to 3 officers per corporation may exempt themselves using Form DWC-250-R.

## Florida Workers' Comp Rates (2026)

Florida workers' comp rates are set by the NCCI and approved by the Florida Office of Insurance Regulation. Rates are expressed as cost per $100 of payroll.

| Industry | Typical Rate Range |
|---|---|
| Clerical / office work | $0.105–$0.31 per $100 payroll |
| Retail / restaurant | $1.50–$4.50 per $100 payroll |
| Plumbing / HVAC | $2.737–$2.995 per $100 payroll |
| Electrical contractors | $2.969–$3.28 per $100 payroll |
| Carpentry / framing | $4.364–$7.689 per $100 payroll |
| Roofing contractors | $6.752 per $100 payroll (FWCJUA 2026) |

## How to Calculate Workers' Comp Premium

**Formula:** (Annual Payroll ÷ 100) × Class Code Rate × Experience Mod (EMR)

**Example:** A roofing contractor with $500,000 payroll, class code 5551 (rate: $6.752), EMR 1.0:
($500,000 ÷ 100) × $6.752 × 1.0 = **$33,760 annual premium**
