Policy Verification

How Does the Florida Workers' Comp Exemption Work?

Who Can File?

Corporate officers (up to 3 per corporation) and LLC members in the construction industry can file for an exemption. Non-construction sole proprietors and partners are automatically exempt.

How Long Is It Valid?

Florida WC exemptions are valid for 2 years. After expiration, the officer must re-file to maintain exempt status. An expired exemption means the person is no longer covered by the exemption.

Why Verify?

Contractors must verify subcontractors' exemption or coverage status before allowing them on a job site. Hiring an uninsured subcontractor can expose the general contractor to liability.

Frequently Asked Questions About Florida WC Exemptions

What is a Florida workers' comp exemption?+

A workers' compensation exemption in Florida allows certain corporate officers, LLC members, and sole proprietors in the construction industry to exempt themselves from workers' comp coverage requirements. The exemption is filed with the Florida Department of Financial Services (DFS).

Does an exemption mean the person has no workers' comp coverage?+

Yes. An active exemption means the individual has opted out of workers' comp coverage. If they are injured on the job, they are not covered by workers' compensation insurance. Contractors should always verify subcontractors' exemption or coverage status before work begins.

What is the construction industry filter?+

The construction filter lets you narrow results to exemptions filed by construction industry workers (Yes), non-construction workers (No), or all industries (ALL, the default). This is especially useful when verifying subcontractors on Florida construction projects.

How current is the exemption data?+

Data is pulled live from the Florida DFS exemption database in real time. There may be a short processing delay between when an exemption is filed or renewed and when it appears in the system.

Can I verify both exemption and active coverage?+

Yes. Use this tool to check for an exemption certificate. Use the Policy Verification tool to check for an active workers' comp policy. A subcontractor should have one or the other — if neither shows up, they may be operating without coverage.
