Do I need an insurance license to participate in this referral program?+
For PEO, payroll processing, and audit defense referrals — no insurance license is required, as these are not insurance products. For insurance product referrals, you do not need a license to make a referral. Under Florida Statute §626.112(8), an unlicensed person may receive a flat referral fee for directing prospective purchasers to a licensed agent, provided the fee is not contingent on whether a purchase is made. What you may not do without a license is describe specific coverage terms, compare policies, advise on insurance matters, or negotiate on a client's behalf.
Can CPAs receive referral fees under AICPA ethics rules?+
AICPA ethics rules permit CPAs to receive referral fees in certain circumstances, but generally require disclosure to the client. We recommend reviewing AICPA ET Section 1.520 (Referral Fees and Commissions) and consulting your state CPA society or ethics counsel before participating in any fee-sharing arrangement.
Can attorneys receive referral fees for sending clients to an insurance agency?+
Florida Bar rules generally prohibit attorneys from sharing legal fees with non-lawyers, but receiving a flat fee for referring a client to a non-legal service provider — such as an insurance agency — is a different matter.
